Michael Sankey represents clients in civil appeals before Texas courts of appeals, the Supreme Court of Texas, and the U.S. Courts of Appeals for the Fifth and Ninth Circuits.
An appeal is not a second trial. It is won on the record, the standard of review, and persuasive writing. Michael handles appeals in both state and federal court.
Appeals from final judgments and appealable interlocutory orders in to the Texas courts of appeals and the Supreme Court of Texas, including appellant and appellee briefs, petitions for review, mandamus, and rehearing.
Civil appeals from federal district courts to the U.S. Court of Appeals for the Fifth Circuit (Texas, Louisiana, Mississippi) and the Ninth Circuit.
Working alongside trial counsel before and during trial so that objections, motions, and the jury charge preserve the issues that matter on appeal.
Every case is different, but most civil appeals follow the same three stages.
Review the judgment and record, identify the strongest issues, and file a timely notice of appeal.
Request the clerk's record and reporter's record, the only evidence the appellate court will consider.
Write the brief that frames the issues, the standard of review, and why the result should stand or fall.
Deadlines matter. In many Texas civil cases a notice of appeal is due 30 days after the judgment is signed, and as few as 20 days in accelerated appeals. If you have a judgment, call (832) 885-9030.
